These Terms of Service (“Terms”) govern your access to and use of UsedRVParts.ca (the “Site”) and all purchases made through it.

UsedRVParts.ca (“Company”, “we”, “us”, or “our”) provides specialty new and used RV parts.

By accessing the Site or completing a purchase, you (“User”, “Customer”, “Buyer”) agree to be legally bound by these Terms, along with our Return Policy and Shipping Policy. If you do not agree, you must discontinue use of the Site.

1. Product Condition, Representation & Availability

1.1 Used RV Parts (Strict “As-Is” Sale)

All used parts are sold:

“AS-IS – WHERE-IS – WITH ALL FAULTS – NO RETURNS – NO REFUNDS – NO WARRANTIES”

To the fullest extent permitted by law:

All warranties (express or implied) are disclaimed, including:

  • Merchantability
  • Fitness for a particular purpose

Additional conditions:

  • Cosmetic wear, aging, and prior use are expected
  • Functional testing may be performed but does not constitute a warranty

1.2 New RV Parts

  • May include a manufacturer warranty only
  • All warranty claims must be handled directly with the manufacturer

UsedRVParts.ca does not:

  • Provide warranty coverage
  • Process warranty claims
  • Guarantee manufacturer outcomes

1.3 Electronic Components

All electronic components (including circuit boards):

  • Are sold final sale, as-is
  • Are not eligible for return or refund under any circumstances
  • Must be handled through manufacturer processes if defective

1.4 Product Listings, Errors & Availability

We reserve the right, at any time and without liability, to:

  • Correct errors in pricing, descriptions, images, or specifications
  • Cancel orders due to:
    • Inventory discrepancies
    • Incorrect listings
    • System or human error

A full refund will be issued where applicable.

2. Pricing, Payment & Fraud Prevention

  • All prices are in CAD or USD unless otherwise specified
  • Prices may change without notice

By placing an order, you authorize:

  • Immediate payment capture
  • Fraud screening and verification

We reserve the right to:

  • Refuse or cancel any order
  • Request identity verification
  • Deny transactions flagged as high-risk
  • Delay shipment pending verification
  • Require signature confirmation on high-risk or high-value orders

Orders suspected of fraud, unauthorized activity, reshipping activity, or policy abuse may be canceled at our sole discretion.

3. Shipping, Delivery & Risk Transfer

  • Shipping timelines are estimates and not guaranteed
  • Risk of loss transfers to the Buyer once the shipment is accepted by the carrier

The Buyer is responsible for:

  • Providing accurate shipping information
  • Monitoring shipment tracking
  • Ensuring a secure delivery location
  • Being available for signature-required deliveries where applicable

UsedRVParts.ca may require signature confirmation on select shipments at our discretion, including higher-value or high-risk orders.

Once tracking indicates a shipment has been delivered, including delivery scan, proof of delivery, GPS confirmation, photo confirmation, or signature confirmation where applicable, the order shall be considered fulfilled and delivered.

The Buyer agrees that carrier tracking records, delivery scans, photo confirmation, GPS confirmation, and signature confirmation constitute valid proof of delivery and fulfillment.

We are not liable for:

  • Carrier delays
  • Customs processing delays
  • Lost or stolen packages after delivery
  • Porch piracy
  • Delivery access issues
  • Failed delivery attempts
  • Carrier-related service interruptions

Important:

Claims for lost or damaged shipments must be filed with the carrier. We may assist in the claims process but are not responsible for carrier decisions or claim outcomes.

All shipping terms are governed by our Shipping Policy.

4. Returns, Refunds & Final Sale Enforcement

  • Used parts: Final sale (no returns or refunds)
  • Electronic components: Final sale (no returns or refunds)
  • New parts: Returns permitted only where approved under our Return Policy

Return Timing Requirement

Return requests must be submitted within 30 days of confirmed delivery, unless otherwise stated in the Return Policy.

Orders confirmed delivered by the carrier, including tracking confirmation, proof of delivery, photo confirmation, GPS confirmation, or signature confirmation where applicable, are considered fulfilled orders.

All return eligibility, fees, and conditions are governed exclusively by the Return Policy.

5. Installation, Compatibility & Buyer Responsibility

The Buyer assumes full responsibility for:

  • Verifying part compatibility
  • Confirming specifications and dimensions
  • Ensuring proper installation

UsedRVParts.ca is not responsible for:

  • Incorrect fitment
  • Installation errors
  • Product misuse
  • Improper diagnosis
  • Buyer-selected incompatibility

Professional installation is strongly recommended.

6. Automated Systems & AI Disclaimer

UsedRVParts.ca may provide automated tools, including AI-powered systems, for general guidance.

The Buyer acknowledges:

  • These tools are informational only
  • Outputs are not guaranteed accurate
  • Compatibility and specifications must be independently verified

We disclaim all liability for:

  • Errors in automated recommendations
  • Reliance on generated information
  • Resulting damages or losses

7. Product Images & Representation

Images may include:

  • Stock photos
  • Manufacturer images
  • Representative examples

Actual items may vary in:

  • Appearance
  • Color
  • Wear and condition
  • Packaging

Written descriptions take precedence over images.

8. Intellectual Property

All Site content, including text, images, logos, product descriptions, graphics, and branding, is the property of UsedRVParts.ca and may not be copied, reproduced, distributed, or used without written consent.

9. Limitation of Liability

To the fullest extent permitted by law:

UsedRVParts.ca shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of income or profits
  • Property damage or personal injury
  • Installation or labor costs
  • Shipping-related issues
  • Carrier delays or failures
  • Lost or stolen shipments after delivery confirmation

Maximum liability is limited to the purchase price of the product.

10. Indemnification

You agree to indemnify and hold harmless UsedRVParts.ca from claims arising from:

  • Use of the Site
  • Purchase or use of products
  • Installation or modification
  • Violation of these Terms
  • Chargebacks or payment disputes initiated in contradiction to disclosed policies

11. Chargebacks & Payment Disputes

By completing a purchase, you agree to contact us first to resolve any issue.

Invalid disputes include:

  • Claims contradicting disclosed policies
  • Manufacturer defect claims directed at UsedRVParts.ca
  • Unauthorized return attempts
  • Claims for packages confirmed delivered by the carrier

We reserve the right to:

  • Contest all disputes with supporting documentation
  • Provide carrier tracking records, proof of delivery, photo confirmation, GPS confirmation, signature confirmation, customer communications, and policy acknowledgements
  • Recover funds, fees, chargeback costs, collection expenses, and associated losses where applicable

The Buyer agrees that carrier delivery records and signature confirmation constitute valid proof of fulfillment and delivery.

12. Governing Law & Dispute Resolution

  • Governed by the laws of British Columbia, Canada
  • Disputes resolved through binding arbitration in Kelowna, BC

You waive:

  • Participation in class actions
  • Jury trial rights (where applicable)

13. Changes to Terms

We reserve the right to update or modify these Terms at any time.

Continued use of the Site constitutes acceptance of any updates.

14. Entire Agreement

These Terms, together with the Return Policy and Shipping Policy, constitute the entire agreement between the Buyer and UsedRVParts.ca.
